Measures for the Expert Committee of Iron Ore Portside Index
Chapter I General Provisions
Article 1. In order to establish a scientific and reasonable pricing mechanism that accurately reflects the price of iron ore, Beijing Iron Ore Trading Center Corporation (hereinafter referred to as “COREX”) has established an Expert Committee (hereinafter referred to as “the Committee”) for the compilation and release of the Iron Ore Portside Index (hereinafter referred to as the “IOPI”) to support the relevant work.
Article 2. The Committee shall adhere to the principles of openness, fairness, independence, and seeking truth from facts.
Chapter II Organizational Structure
Article 3. To ensure that all market participants can share their opinions, COREX invites a diverse range of enterprises and organizations, including steel mills, mining companies, traders, and iron ore industry service providers, to form the Committee.
Article 4. The Committee members serve a two-year term, and will be reappointed by default at the end of each term if no objections are raised by either party. Should a member withdraw or be replaced during the term, the Committee must notify COREX in writing.
Chapter III Scope of Responsibilities
Article 5. Committee members shall provide recommendations, such as the iron ore quality normalization adjustment value, in line with the data provision requirements set by COREX. The suggestions will serve as a reference for compiling the IOPI.
Article 6. Committee members may propose adjustments to the “Methodology Specifications of IOPI” according to market changes.
Chapter IV Rights and Obligations
Article 7. Committee members shall enjoy the following rights:
(1) Obtain necessary information regarding the “Methodology Specifications of IOPI” and the revision instructions, etc., for the purpose of performing their duties;
(2) Participate in the revision of the “Methodology Specifications of IOPI” and provide professional suggestions.
Article 8. Committee members shall undertake the following obligations:
(1) Strictly adhere to national laws and regulations as well as the relevant policies and rules of COREX, provide professional opinions objectively and impartially in line with the “Methodology Specifications of IOPI”, and shall not let personal interests compromise the independence of decision-making.
(2) Provide data promptly and accurately, ensuring that all information is truthful and complete.
(3) Uphold confidentiality regarding any unpublished data and business secrets etc., obtained during the compilation of the index, and shall not disclose such information to any third parties.
Chapter V Supervision and Administration
Article 9. COREX shall supervise the Committee members’ performance of duties, and has the right to consult relevant Committee documents, require explanations for any questionable matters and corrections for any violations, and oversee their implementation.
Article 10. COREX has the right to revoke its membership when a Committee member falls under any of the following situations:
(1) Providing false data or certification materials that may affect the accuracy of index compilation;
(2) Disclosing unpublished materials or information related to index;
(3) Engaging in any other illegal or irregular activities.
Chapter VI Supplementary Provisions
Article 11. COREX reserves the rights to interpret and revise these Measures.
Article 12. These Measures shall enter into force as of the date of promulgation.
Article 13. Both Chinese and English versions are valid. In case of any inconsistency, the Chinese version shall prevail.
鐵礦石港口現(xiàn)貨價格指數(shù)專家委員會管理辦法
第一章 總則
第一條 為建立科學(xué)合理的定價機制，客觀反映鐵礦石價格，北京鐵礦石交易中心股份有限公司（以下簡稱“北鐵中心”）為編制發(fā)布鐵礦石港口現(xiàn)貨價格指數(shù)設(shè)立專家委員會（以下簡稱“專委會”），以支持指數(shù)相關(guān)工作。
第二條 專家委員會遵循公開、公正、獨立、開放、實事求是的工作原則。
第二章 組織機構(gòu)
第三條 為充分聽取市場各方意見，北鐵中心邀請鋼廠、礦山、貿(mào)易商、鐵礦石行業(yè)服務(wù)機構(gòu)等各類企業(yè)或組織組成專家委員會。
第四條 專委會成員任期2年，到期后雙方如無異議，則自動連任。任期內(nèi)如有退出或更換，需由專委會成員書面通知北鐵中心。
第三章 職責范圍
第五條 專委會成員參照北鐵中心相關(guān)數(shù)據(jù)提供要求，提供鐵礦石品質(zhì)標準化調(diào)整值等建議，作為鐵礦石港口現(xiàn)貨價格指數(shù)編制的參考依據(jù)。
第六條 專委會成員可根據(jù)市場情況變化，對指數(shù)編制方案提出調(diào)整建議。
第四章 權(quán)利與義務(wù)
第七條 專委會成員享有以下權(quán)利：
（一）獲取指數(shù)編制方案、修訂說明等為保障履職所需的相關(guān)信息；
（二）參與指數(shù)編制方案的修訂，對指數(shù)編制方案提出專業(yè)建議。
第八條 專委會成員承擔以下義務(wù)：
（一）嚴格遵守國家法律法規(guī)及北鐵中心相關(guān)規(guī)章制度，按照指數(shù)編制方案客觀、公正地提供專業(yè)意見，不得因自身利益影響決策獨立性；
（二）及時、準確提供數(shù)據(jù)，確保數(shù)據(jù)真實、完整；
（三）對指數(shù)編制過程中接觸的未公開數(shù)據(jù)、商業(yè)秘密等承擔保密責任，不得向第三方披露。
第五章 監(jiān)督管理
第九條 北鐵中心對專委會成員的履職情況進行監(jiān)督，有權(quán)查閱專委會相關(guān)文件，并要求其對存疑事項進行說明，對違規(guī)行為提出整改意見并監(jiān)督落實。
第十條 專委會成員如有下列情形之一，北鐵中心有權(quán)取消其專委會成員資格：
（一）提供虛假數(shù)據(jù)或證明材料，影響指數(shù)編制準確性；
（二）泄露指數(shù)未公開資料、信息；
（三）其他違法、違規(guī)行為。
第六章 附則
第十一條 本辦法由北鐵中心負責解釋和修訂。
第十二條 本辦法自發(fā)布之日起實施。
